The Work/Family, Employee
Assistance Program helps employees and their families in many areas. We
would like to inform you about how our UAW-GM Legal Services plan can be
used to your advantage |
|
| Full legal services including litigation
are covered benefits. The plan provides full legal services and any costs of litigation
required in connection with the following matters: |
| 1. Suspension or termination of Social
Security benefits. |
| 2. Wills, Codicils (amendments to wills),
Power of Attorney and trusts. |
| 3. Probate proceedings. |
| 4. Guardianship. |
| 5. Real Estate Closings for
family or personal residences. |
| 6. Other real estate matters,
involving family or personal residence, including purchase, sale, mortgage, foreclosure, boundary disputes, title dispute zoning,
and eminent domain. |
| 7. Tenant representative. |
| 8. Leases for tenants on
personal or family residences. |
| 9. Property tax assessment
disputes. |
| 10. Consumer complaints and warranty
problems |
| 11. Medicare appeals. |
| 12. Uncontested divorces,
custody, support and alimony disputes - only in jurisdictions where attorneys appear in Court to finalize. |
| 13. Post divorce modification
of child support or alimony based solely upon material change in the worker's income from the company. |
| 14. Consumer contracts. |
| 15. Insurance claims of loss of
coverage. |
| 16. Defense of collection
action on personal or family debts. |
| 17. Defense of garnishments. |
| 18. Personal Bankruptcy. |
| 19. Repossession and replevin. |
| 20. IRS Audits and
Administrative proceedings; ( administrative appearances only ) |

| 4. Moving Violations. |
| 5. Other traffic offences,
except for parking violations. |
| 6. Misdemeanors. |
| 7. Juvenile offenses. |
| 8. Divorce, separation,
annulment, dissolution, maintenance and child custody. |
| 9. Non-support and alimony. |
| 10. Naturalization, immigration
and deportation. |
| 11. Federal, state or local
claims to taxes, other than IRS audits and administrative proceedings. |
| 12. Trusts, wills, real estate
and probate matters to deal with the death or incapacity of mother or father of the participant. ( Effective March 1,
2000 ) |

Services covered under the Family Estate Planning Benefit |
| All
services provided under this benefit must be in preparation for the
death or incapacity of the Employee/Retiree's parents, stepparents or
those of his or her spouse. This may include: |
| Wills for parents and
stepparents, Trusts for parents and stepparents (estates with assets
over $675,000 - call Deborah Brouwer or Bill Ridley for approval) |
| Deeds and Powers of Attorney-Employee / Retiree need
not be grantee or grantor |
| Real estate closing on parents' or stepparents, if the
transaction is in preparation for the death or incapacity of
Employee/Retiree's spouse. |
| Office work benefits (advice, counseling and letters)
for other real estate, probate, guardianship, or nursing home matters,
if they arise in connection with preparations for the death or
incapacity of Employee/Retiree's parents or stepparents. |
|
| The types of office work that may be provided under
this paragraph include the following: |
| 1. Legal drafting-preparation of legal documents |
| 2. Legal research |
| 3. Factual evaluations |
| 4. Document review |
| 5. Telephone calls |
| 6. Correspondence |
| 7. Self-help Counseling, where appropriate |
|
| Whenever a Plan Staff Attorney determines that a
referral to a Cooperating Attorney is required because services beyond
the office work benefit are necessary, the benefits under this paragraph
are included. |
|
| Limitations and exclusions from coverage |
| Litigation coverage is not provided for personal injury
Torts of plaintiff actions on small claims ($700 or less). Plan
benefits do not include preparation of tax returns, matters where
representation on a contingent fee basis is available, or matters where
litigations is pending |
| The following are excluded form all coverage: |
|
1. Any proceeding against the Corporation, its
subsidiaries, its dealers, or any of its officers or agents; |
| 2. Any proceeding against the Union, any of its
subordinate or affiliated bodies, or the Officers or agents of such, or
against any labor organization representing employee of the company; |
| 3. Any proceeding where the Union itself would be
prohibited from defraying the costs of such legal services by the
provisions of the Labor-Management Reporting and Disclosure Act 1959,
and any Proceeding arising under the National Labor Relations Act
or the Labor Management Relations Act, as Amended; |
| 4. Fines and penalties, whether civil or
criminal' |
| 5. Any judgment for civil damages; |
| 6. Any Actions pending on or before January 01,
1983; |
| 7. Legal Services that are not personal legal
services within the meaning of Section 120 in the Internal Revenue Code
of 1986, as amended while that section was in effect; |
| 8. Any proceeding involving another eligible
Participant as an adverse party, unless the participants are separately
represented; |
| 9. Non-legal costs attendant to the purchase or
sale of real estate; |
| 10. Matters involving election laws, or warrant
to any civil office; |
| 11. Worker's Compensation or Unemployment
Compensation matter involving the Corporation; |
| 12. Any Bankruptcy proceeding that would result
in discharge of a debt owed to the Corporation, the Union, or any
benefit plan or trust established or Maintained by the Corporation; |
| 13. Any dispute involving the Plan; |
| 14. Proceedings against any benefit plan or
arising out of any benefits plan established or maintained by the
corporation, including proceedings against any trust or insurance
carrier through which such benefits are provided to the Corporation, it
employees or retirees. |

| How you can obtain benefits under the plans |
| Plan Participants who live or work near one of the
Plan's offices will receive their legal service benefits from staff
attorneys employed exclusively by the Plan in those offices. When
you call one of these offices, your eligibility will be checked,
and an appointment with an attorney will be made for you. If you
prefer, you can talk first with an attorney by telephone.
Participants who do not live or work near the Plan's offices will
receive their legal services benefits from a private attorney, called a
Cooperating Attorney, who has contracted with the Plan to provide you
legal services. To obtain a referral to a Cooperating Attorney, call
on of your Work/Family, EAP Representative, or you can call the Plan's
